Terms and Conditions – AluElite

These Terms and Conditions (“Agreement”) govern the use of AluElite’s products and services provided by BM Bi Folding Doors, trading as AluElite, hereinafter referred to as “AluElite,” “we,” “us,” or “our.” By accessing, browsing, or using our products or services, you (“Customer,” “you,” or “your”) agree to be bound by the terms and conditions outlined below. 2.2 Product Availability: While we strive to ensure product availability, we cannot guarantee the immediate availability of all items. In the event that a product is out of stock or unavailable, we will make reasonable efforts to notify you and provide alternative options.

2.3 Measurements and Specifications: It is your responsibility to provide accurate measurements and specifications for the products or services you require. AluElite will not be held liable for any inaccuracies resulting from incorrect or incomplete measurements or specifications provided by you.

2.4 Installation and Maintenance: If you choose to utilize our installation or maintenance services, AluElite will perform the work to the best of our abilities. However, we are not responsible for any damage, loss, or delay that may occur during installation or maintenance, except in cases of negligence or willful misconduct on our part.

  1. Orders and Payment

3.1 Pricing: The prices of our products and services are displayed on our website or provided through written quotations. All prices are subject to change without notice. Any additional taxes, duties, or fees imposed by governing authorities shall be your responsibility.

3.2 Orders: Placing an order with AluElite constitutes an offer to purchase our products or services. We reserve the right to accept or reject any order at our sole discretion. Once an order is accepted, it is considered binding.

3.3 Payment: Payment for products or services must be made in full at the time of purchase unless otherwise agreed upon in writing. 5.2 Exclusions: The warranty does not cover damages resulting from improper installation, misuse, neglect, accidents, alterations, natural disasters, or unauthorized repairs. The warranty is also void if the product is used for purposes other than its intended use or if maintenance guidelines provided by AluElite are not followed.

5.3 Warranty Claims: To make a warranty claim, you must provide proof of purchase and notify AluElite within the specified warranty period. AluElite reserves the right to assess the claim and determine whether to repair or replace the product, or provide a refund or credit, at our discretion.

  1. Limitation of Liability

6.1 Indirect Damages: In no event shall AluElite be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our products or services, including but not limited to loss of profits, loss of data, or loss of business opportunities.

6.2 Maximum Liability: AluElite’s maximum aggregate liability to you for any claims relating to our products or services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.

  1. Governing Law and Jurisdiction

7.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where AluElite is based, without regard to its conflict of laws principles.

7.2 Jurisdiction: Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where AluElite is based.

  1. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

  1. Entire Agreement

This Agreement constitutes the entire agreement between you and AluElite concerning the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral.

By using AluElite’s products or services, you affirm that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of this Agreement, please refrain from using our products or services.
